Child Custody Attorney



Child custody is one of the most emotionally charged issues in family law.  Our children are dear to us and it is often difficult for parents after separation to agree on child custody issues such as who will be the primary custodial parent, a visitation schedule, child support, and other issues. 



When child custody is in dispute courts generally look to what is in the "best interests of the child" but what is in the best interests of the child is not always clear. This is why a child custody attorney is vital when you are in a child custody dispute.

Things can get messy in child custody cases if one parent is unreasonable or is willing to fabricate false allegations and lie to gain an advantage in obtaining child custody orders.  It is not uncommon in child custody cases for a parent to be legitimately concerned about substance abuse by the other parent, physical abuse by the other parent, or have several legitimate concerns about the other parent. It is also not uncommon in child custody cases for one parent to completely make up concerns about physical abuse, sexual abuse, or drug abuse about the other parent. The Family Code provides a perverse incentive for false allegations of domestic violence in child custody cases by providing a rebuttable presumption that an award of sole or joint physical or legal custody of a child to a person who has been found to have perpetrated domestic violence within the previous five years is detrimental to the best interest of the child.



The Law Offices of Justin Kirk Tabayoyon believes in child custody cases it is best for parents to be reasonable, work together, set their own interests aside, and do what is in the best interest of their child. However, if one parent is unwilling to be reasonable and seeks to put their own interests ahead of the best interests of their child, and when truth is a foreign concept to the that parent, we believe in an aggressive approach as opposed to a passive, reactive approach.
